FLP2 Property, Maintenance and Child Support
What is this subject about?
This subject deals with property and financial matters such as spousal maintenance, child support and superannuation splitting.
The subject aims to provide a strong foundation for practising in this area of family law, assuming that you may already have a reasonable familiarity with the basic principles of the subject.
The subject covers the issues most commonly encountered by family law practitioners in everyday practice. A later advanced subject deals with topics which are less frequently encountered in practice.
What will I learn while studying this subject?
At the end of this subject you will be able to:
- demonstrate an understanding of the substantive law in regard to the division of property and financial transfers following relationship breakdown
- identify all relevant issues and problems which require further research of the law
- apply the four steps of analysis in section 79 matters
- develop a methodology to resolve a number of common problems in regard to this area of practice
- prepare for and conduct an effective conciliation conference
- identify and resolve ethical and professional practice issues which arise in this area of practice
Topics in this subject will include:
- conducting the four-steps of analysis in section 79 matters
- an overview of the ways of finalising a property settlement agreement, includingdrafting the various documents
- taxation issues in property agreements and orders
- superannuation splitting
- an introduction to child support
- spousal maintenance
- ethics in family property law matters
How will I be assessed?
This subject has the following assessments:
- conciliation conference documents (20%)
- documenting the agreement (20%)
- written examination (60%)
If you enrol in this as a single subject on a non-award basis then you do not have to complete the assessment.
