Consumer Credit and Real Property Mortgages Update

The National Consumer Credit Protection Act 2009 (Cth), National Credit Code, National Consumer Credit Protection (Transitional and Consequential Provisions) Act 2009 (Cth), National Consumer Credit Protection Regulations 2010 (Cth), National Consumer Credit Protection (Fees) Act 2009, National Consumer Credit Protection (Transitional and Consequential Provisions) Regulations 2005 and National Consumer Credit Protection (Fees) Regulations 2010 comprise a national consumer credit regime. This regime, which commenced on 1 July 2010, confers rights on borrowers and imposes obligations on credit providers where the credit contract falls within the regime. This paper attempts to deal only with the rights conferred on mortgagors and the obligations imposed on mortgagees of real property by this regime.

Peter Walsh is a barrister practicing mainly in equity and commercial law. He has obtained the degrees of Bachelor of Arts and Bachelor of Laws from the University of New South Wales and Master of Laws from Sydney University. He was admitted as a solicitor in 1981 and as a barrister in 1988. Since admission as a barrister he has practised from University Chambers.
