Contract Drafting - Tips and Traps

This paper will explore some common tips and traps in the contract drafting process, from the time instructions are received and obtained, through to the drafting stage, and negotiation and finalisation of the contract.

Luke Aiken was admitted as a solicitor of the Supreme Court of NSW in 1994. He joined Thomsons Lawyers (formerly Cutler Hughes & Harris/Thomson Playford Cutlers) as a Partner in 2008 and is a specialist construction lawyer with over 15 years' experience, working on behalf of developers, contractors and specialist sub-contractors. He has worked on numerous development projects ranging from large scale infrastructure and commercial developments, high rise residential to aged care and retirement village facilities.

Luke has both front-end and back-end construction expertise. He has a thorough understanding of all industry standard contracts, and regularly drafts and negotiates construction contracts. He advises on all aspects of contract administration, risk allocation and management for construction projects and construction disputes, including litigation and alternative dispute resolution.
