Fitness for Purpose: An Overrated Warranty

This seminar looks at fitness for purpose. Essentially, fitness for purpose is a 'quality' warranty. If the purpose is not specified then it must be fit for the usual purpose/s ie the concept of merchantability.

The nineteenth century background to the implication of the term in sales of goods reflects the view that "a purchaser cannot be supposed to buy goods to lay them on a dunghill". They must be fit for some purpose or, if sold for a particular purpose, then for that purpose.

Wendy Roydhouse has been legal counsel at Bovis Lend Lease for 13 years. She negotiates and drafts contracts, subcontracts and consultancy agreements for a variety of projects.

Prior to this, she was at Mallesons, where she acted for developers and banks on a broad range of residential and commercial projects.

Wendy started her career at the Master Builders Association of NSW, advising builders and subcontractors and sitting on various committees drafting standard form contracts.
