Unconscionable Conduct & Retail Leases (with Podcast)

Unconscionable Conduct & Retail Leases - looks at what constitutes unconscionable conduct in retail lease litigation, in partricular s62B and s 62D of the Retail Leases Act 1994.

Dr John Keogh commenced practice at the NSW Bar in 1990. His practice focuses on property, planning, building and development law and associated commercial matters. He appeared in a number of RLA matters before the ADT in 2008-2009. John was the president of the Commercial Law Association of Australia from 2001 to 2006 and maintains a keen interest in the evolution of the law as Deputy Chair of the CLA's Legislative Review Taskforce. He was awarded a law doctorate by UTS in 2000 for his thesis on environmental due diligence.

John holds appointments to judicial and government bodies in the areas of arbitration, commercial mediation, and neutral evaluation, and was appointed to the government Retail Tenancy Unit mediation panel in early 2009.

From 1992-2002 Dr Keogh also lectured in planning and environmental law, commercial tenancy law and building and construction law in addition to his current practice at the Bar. Since 1992, Dr Keogh has written and published numerous articles on property law issues. He regularly presents papers on these topics at seminars and conferences. Since 2005, he has contributed a regular quarterly feature in the Australian Property Journal on legal issues as the editor of Legal Notes.
