Workers Compensation - Section 9A

This seminar will look at the introduction of section 9A into the Workers Compensation Act 1987 ("WCA") which limits the compensability of claims to situations where the employment is a substantial contributing factor to the worker's injury.

The intended purpose of the provision is clear – it seeks to deny compensation to certain workers who would have previously received it.

As a result of the enactment of section 9A a worker must independently establish that he/she sustained an injury arising out of or in the course of employment and that the employment was a substantial contributing factor to the injury.
